1 – Objective

This document establishes the pre-contractual information regarding contracts concluded at a distance on the Whiter.pt website, as referred to in article 4 of Decree-Law nº 24/2014 of February 14, and all subdomains/sub-websites.

The Whiter.pt domain is owned by Whiter Progress – Innovative Cleaning Solutions, Lda., with headquarters at Rua Almirante Sousa Dias, Loja 4B 2780-299 Oeiras, legal entity nº 513 499 342, hereinafter referred to as Whiter.

Whiter reserves the right to freely modify this pre-contractual information to adapt it to applicable legislation, without prior notice.

Both browsing the website www.whiter.pt, its subdomains and sub-websites, as well as the purchase of any product at those addresses, implies the acceptance of this information and general conditions of use.

2 - Conditions of use of www.whiter.pt

The User undertakes to use these websites in compliance with applicable legislation, refraining from using the website for activities contrary to the law, morality and good customs, or the rights and interests of third parties.

The website www.whiter.pt may have links to other websites, with useful information/tools for its users. However, these general conditions are not applicable to third-party websites. As such, if the user visits another website, redirected from our website, they should read its privacy policy.

3 - Alteration of these Conditions

Whiter reserves the right to unilaterally and at any time, without prior notice, modify the presentation and content of the website, its services and the general conditions of use, safeguarding contracts already concluded and in execution. These modifications will serve to improve the website, simultaneously improving the services offered to the website user who, if they do not agree with the changes introduced, may terminate the contract.

4 - Intellectual property

All content and information contained in www.whiter.pt and its subdomains are the property of Whiter, and therefore the use, reproduction, copying, and dissemination by other means of logos, texts, images, and videos contained on that website is subject to its prior authorization.

5 - Information on Products and Prices

5.1 Product Information

Whiter takes into consideration information relating to the essential characteristics of the products through technical descriptions shared by its suppliers, and photographs and videos that illustrate the products sold, in strict compliance with the best market standards.

5.2 Price Information

The retail prices indicated on www.whiter.pt and its subdomains are presented in euros. VAT is included in all mentioned prices.

The prices and products available on www.whiter.pt are only valid for purchase orders made through www.whiter.pt.

On the www.whiter.pt website, there may be promotional price offers in the form of a percentage discount applied to the selling price. The discount percentage and the final price (after discount) will be visible immediately in the product category or subcategory lists and in search results lists. The product sheet/detail will include the mention "on promotion!", as well as the validity period of the respective discounts. These discounts represent a commitment during the announced period, but always on the condition that the order is finalized through "check-out" on a "refreshed" page (cache or unrefreshed pages may show discounts that are no longer in effect) and is properly registered. The discount or price viewed is only guaranteed if whiter.pt receives the respective payment within a maximum of 2 days, counted from the date of completion of the "check-out" and registration of the order.

Any sales proposals with the mention of Clearance or Liquidation will always be communicated to ASAE in advance, with 5 working days and 15 working days notice, respectively.

All items presented on the website are subject to stock availability at the time of order confirmation. Missing items will not be invoiced, and you may opt for a similar item replacement. In case of replacement, the invoiced price will be that of the substitute product and not the originally ordered one.

The costs of the delivery service are borne by the user / buyer and are added to the total value of the selected products. The user will be informed of these charges before confirming their order and completing the purchase process. Whiter reserves the right to change prices at any time. However, Whiter undertakes to apply the rates and prices indicated at the time of placing the purchase order.

Should a computer, manual, technical, or any other error occur, causing a substantial change not foreseen by Whiter in the retail price, in such a way that it becomes exorbitant or manifestly derisory, the purchase order will be considered invalid and cancelled.

6 - Purchase process in the Online Store

6.1 Registration To place a purchase order, it is necessary to access www.whiter.pt, and register as a customer on that website, filling in the electronic form according to the instructions of each step, or, if desired, you can make the purchase as a guest, only needing to fill in some data.

After registration, the user can proceed to purchase their product(s).

6.2 Product availability All items on the www.whiter.pt website are available for order. However, some items may become unavailable without warning due to stockout. In this case, Whiter will notify the user of the unavailability of the ordered item and the foreseeable date of its replenishment. However, as we have a wide variety of products available, it is always possible to find similar and substitute items that meet the needs and have the characteristics the customer desires.

6.3 Online Store Payment Methods The payment methods available in the www.whiter.pt online store are: bank transfer, ifthen or Hipay. Orders will be processed after payment confirmation. The customer may, in order to expedite the bank transaction confirmation, send the transfer receipt to encomendas@whiter.pt if they have chosen bank transfer.

6.4 Delivery Costs for products purchased in the Online Store 6.4.1 Home delivery The delivery of ordered items to the user's home has an associated cost, to be borne by the customer and added to the value of the products. The delivery postage value will be calculated based on the distance traveled for delivery, amount and volume of the order, this value will be communicated to the user before the items are shipped. Home deliveries are only made in the municipality of Oeiras.

6.4.2 Collection at Headquarters The collection of the order at Whiter's headquarters through the "Pick Up and Go" method is free of charge. The customer, or someone mandated by them, must, after payment of the order, go to the facilities and collect it.

6.5 Fees and Taxes The retail prices indicated on www.whiter.pt and its subdomains are presented in euros. The VAT due is included in all prices. The delivery service costs depend on the delivery method, delivery address, and total order value. 6.6 Order Processing and Delivery After confirmation of payment, delivery to the address indicated by the customer – in the municipality of Oeiras – is the responsibility of Whiter, who will forward the products by its own means.

6.7 Order Tracking Any programming errors or defects in the functioning of the computer system (machine) are reserved, under the terms and for the purposes of articles 32 and 33, no. 2, paragraphs a) and b) of Decree-Law 7/2004, of January 7. 7 - Warranty Articles sold by Whiter on www.whiter.pt are covered by the legal warranty regime, in accordance with the provisions of article 5 of Decree-Law no. 67/2003, of April 8, with amendments introduced by Decree-Law no. 84/2008, of May 21. Returns: For Damaged Product – You should go to Whiter's headquarters, presenting the invoice and the complete item. If this option is not possible, you should contact us by phone and we will help you solve the problem. For Transport Damage - If you detect any anomaly or damage caused by the transport of the item you ordered, you must notify our helpline (+351 216 086 855).

To expedite the bank transaction confirmation, the client may send the proof of transfer to encomendas@whiter.pt if they have chosen bank transfer.

6.4 Delivery Costs for products purchased in the Online Store

6.4.1 Home delivery

The delivery of ordered items to the user's home has an associated cost, to be borne by the customer and added to the value of the products. The delivery postage value will be calculated based on the distance traveled for delivery, amount, and volume of the order, this value will be communicated to the user before the items are shipped.

Home deliveries are only made in the municipality of Oeiras.

6.4.2 Collection at Headquarters

The collection of the order at Whiter's headquarters through the "Pick Up and Go" method is free of charge, and the customer or someone mandated by them must, after payment of the order, go to the facilities and collect it.

The costs of the delivery service depend on the delivery method, delivery address, and total order value.

6.6 Order Processing and Delivery

After confirmation of payment, delivery to the address indicated by the customer – in the municipality of Oeiras – is the responsibility of Whiter, which will forward the products by its own means.

6.7 Order Tracking

Any programming errors or defects in the functioning of the computer system (machine) are reserved, under the terms and for the purposes of articles 32 and 33, no. 2, paragraphs a) and b) of Decree-Law 7/2004, of January 7.

7 - Warranty

Articles sold by Whiter on www.whiter.pt are covered by the legal warranty regime, in accordance with the provisions of article 5 of Decree-Law no. 67/2003, of April 8, with amendments introduced by Decree-Law no. 84/2008, of May 21.

Returns:

For Damaged Product – You should go to Whiter's headquarters, presenting the invoice and the complete item. If this option is not possible, you should contact us by phone and we will help you solve the problem.

For Transport Damage - If you detect any anomaly or damage caused by the transport of the item you ordered, you must notify our helpline (+351 216 086 855).

8 – Returns and Right of free termination of the contract

8.1 Right of free termination

The consumer has a period of 14 days, counting from the day on which they acquire physical possession of the goods or from the day on which they acquire physical possession of the last good, in the case of several goods ordered in a single order and delivered separately, to return their order, and without needing to state a reason, in accordance with the provisions of no. 1 of article 10 of Decree-Law no. 24/2014, of February 14.

If they so wish, the consumer fills in and sends electronically the model free termination form or any other unequivocal statement of termination.

This can be done, provided the item is in the same conditions as it was sold, in its original packaging and with a validity date later than the complaint submission date, in two ways:

  • By going to Whiter's headquarters, presenting the invoice and corresponding transport guide and proof of identification (Citizen Card).
  • Contacting our telephone line +351 216 086 855 for information about shipping procedures.

Note: Never ship the item to Whiter without prior contact with the Support Line +351 216 086 855.

8.2 Return Conditions in case of contract termination

  • Only returns of items without signs of undue use are accepted, and whose handling in no case exceeds what is normally permitted in a commercial establishment, in accordance with and for the purposes of paragraph 3 of article 13 and paragraph 2 of article 14 of Decree-Law 24/2014 of 14/02.
  • Return of the complete item.
  • Return Period: Up to the 14th consecutive day, from the day of delivery, in accordance with the provisions of paragraph 1 of article 10 of Decree-Law 24/2014, of February 14.

Refund: In case of return, the refund of the purchase amount will be made using the same payment method used by the consumer in the initial purchase and which does not incur costs for the consumer, after validation of compliance with the return conditions described above, with Whiter having a period of up to 14 days for this purpose.

The consumer must return the goods no later than 14 (fourteen) days from the date on which they informed Whiter of the decision to terminate the contract, bearing the costs of returning the goods.

The right to terminate the contract does not apply, and the consumer cannot freely terminate the following contracts:

  • Supply of goods manufactured according to consumer specifications or clearly personalized;
  • Supply of goods that, by their nature, cannot be re-sent or are liable to deteriorate or expire quickly;
  • Supply of sealed goods not suitable for return, for reasons of health protection or hygiene when unsealed after delivery;
  • Supply of goods that, after delivery and by nature, become inseparably mixed with other products.

8.3 Return Policy www.lmalimentar.pt (online store)

If you purchased an item at www.whiter.pt, you have 14 days to return your order. You can do so provided the item is in the same condition in which it was sold, in its original packaging, and accompanied by all its accessories. You can do this by contacting our telephone line (+351 216 086 855) for information on shipping procedures. It is not possible to ship the item to Whiter without prior contact with the telephone line.

The return conditions are as follows:

  • Items without signs of undue use;
  • Return of the complete item;
  • Return Period: Up to the 14th consecutive day, from the day of delivery.

9 – Repairs / After-sales assistance

If you wish, we guarantee the collection of the item and the handling of the entire Technical Assistance process. You must make prior contact with our Service at +351 216 086 855 or geral@whiter.pt.

10 - Customer Support: Help, Suggestions and Complaints

At any time, the website user can contact Customer Support, via the email address geral@whiter.pt, or by calling +351 216 086 855 from 9:00 am to 6:00 pm, Monday to Friday.

11 - Liability

Whiter is not responsible for damages resulting from any computer viruses or any other situations beyond its control that prevent access and correct functioning of the www.whiter.pt domain, as well as the services provided therein.

12 - Privacy and data protection policy

Whiter respects the privacy of all users of its website and undertakes to protect the personal information that each user chooses to share. Some sections and/or functionalities of this website can be browsed without the need to disclose any personal information by the user.

However, when the collection of personal information is necessary to provide services or when each user decides to provide some of their personal data, the use of that information and those data will be carried out in compliance with the applicable legislation on personal data protection - Law 67/98 of October 26, Data Protection Law - to ensure the confidentiality and security of the personal data provided.

The entity responsible for the collection and processing of personal data is Whiter Progress- Innovative Cleaning Solutions, Lda.

The provision of personal data is optional and the right to access, rectify and cancel any data provided will always be guaranteed, under the terms of the law, and that right can be exercised in person or in writing, directly to the address of the registered office, stated on the website's homepage.

13 - Applicable law

These general conditions and all contracts that may be concluded under them are governed by Portuguese law.
